LIABILITY

Tailpipe is not a party to any transactions carried out via the Swapmeet and has, thus, neither knowledge nor capability to control any items being offered via the Swapmeet or any information provided by the seller regarding such items. Tailpipe is therefore not, under any circumstances, responsible for the items being offered via the Swapmeet or for the marketing and information of such items. Tailpipe is not, under any circumstances, obligated to pay any damages or other compensation to any party because of erroneous information; faults or deficiencies in an item; late or no delivery of an item; late or no payment or for any other reason because of transactions via the Swapmeet. If Tailpipe, in spite of the above, is held liable to any party for any of the above-mentioned reasons, the member who has caused the damage for which Tailpipe is held liable, shall indemnify Tailpipe for all costs and all damages incurred in connection therewith.

Tailpipe can not be held responsible in any way for any printing errors on the Swapmeet or for any loss of data or for any errors, distortions or non-delivery of any bids made via the Swapmeet.

Tailpipe shall not be liable if Tailpipe’s performance of any of its obligations are prevented or obstructed because of an event not reasonably foreseeable and whose effects Tailpipe is not capable of overcoming without unreasonable expenses or losses (e.g. acts of government, strikes, lockouts and other general labour disputes, accidents or breakdown or general unavailability of transport facilities etc.).

The Swapmeet is normally available 24 hours per day, seven days a week. The operation of the Swapmeet is, however, not supervised during all hours of the day. Tailpipe is not, under any circumstance, liable for any disruptions or periods of unavailability of the Swapmeet or for any errors, data viruses etc. on the Swapmeet.
